From quantity to quality

Since late 2022, Hong Kong has run one of the world's most ambitious talent-attraction agendas. The headline has shifted from headcount to retention: attracting talent is step one, but keeping talent in Hong Kong is the harder, more valuable work. For employers, that means reading Hong Kong and the Mainland at once — visas and stay, pay and tax, employment law and family logistics.

The Bay Area dimension

The Greater Bay Area Youth Employment Scheme (GBAYES) is now a year-round programme. It backs eligible young Hong Kong residents with sub-degree or higher qualifications to take up work in the Mainland cities in the GBA, with a Government salary subsidy. Current subsidy rates and the annual application window are published by the Labour Department — confirm them before advising any candidate.

Some Hong Kong residents working in Mainland GBA cities may be eligible for individual income tax support. Eligibility and application requirements vary by city, tax year and individual circumstances.

Cross-border social security remains a friction point — the “double contribution” problem. Some Mainland GBA cities may have arrangements relating to Hong Kong MPF and local social insurance. Extension-of-stay window widened

Hong Kong has widened the period for submitting certain extension-of-stay applications across major talent schemes. Plan early to avoid any lapse.

Continuous contract threshold widened

The continuous-contract threshold was widened, extending full Employment Ordinance protection to more part-time and casual staff. Review contracts for hourly and gig arrangements.

Statutory Minimum Wage revised

The Statutory Minimum Wage is revised under an annual-review mechanism. Re-baseline payroll and contract-staff cost models accordingly.

MPF “offsetting” abolished

Severance and long-service payments for post-transition periods can no longer be offset against MPF contributions — strengthening retirement protection and lifting employer end-of-service cost. Factor this into any outsourcing or secondment maths.

Talent List expanded

The Talent List is expanded periodically with new professions aligned to Hong Kong’s development priorities. A profession on the Talent List may provide immigration facilitation, subject to the requirements of the relevant scheme.

Talent admissions, answered

What is the difference between TTPS, QMAS and ASMTP?
TTPS (高才通) targets high-earners and graduates of designated top universities — no prior job offer required for the initial stay. QMAS (優才) is a quota-based merit scheme (General / Achievement points tests) with no need for a local job offer at application. ASMTP (專才) is employment-tied: a Hong Kong employer must sponsor a Mainland talent to fill a role where local talent is unavailable.
Can a Mainland company second staff to Hong Kong?
Yes, but the assignee still needs a valid Hong Kong work visa. A Mainland parent company cannot simply “second” staff without immigration clearance. Common routes: ASMTP (if the HK entity is the employer) or GEP; the individual must meet eligibility and the HK company must show genuine operations.
How long does a TTPS application take?
Processing times vary; the ImmD publishes indicative timeframes for routine TTPS cases, and electronic submission is available. Confirm current timeframes on the ImmD website.
How can long-term residence lead to the right of abode?
Talent admitted under these schemes is usually granted an initial stay, followed by extensions subject to continued eligibility. Long-term ordinary residence in Hong Kong may lead to eligibility to apply for the right of abode, subject to the applicable Hong Kong laws and individual circumstances. Extensions of stay require proof of employment or business contribution.
Does the GBA tax subsidy apply to HK employees?
Some Hong Kong residents working in Mainland GBA cities may be eligible for individual income tax support, subject to the applicable national, Guangdong and city-level requirements.
Can dependants work or study?
Dependants (spouse and unmarried children under 18) admitted with the principal may study in Hong Kong freely; the spouse may work in Hong Kong without a separate employment visa (subject to the dependant visa conditions).
What counts as the applicable income threshold for TTPS Category A?
Category A requires proof of the applicable level of taxable employment or business income in the year preceding the application. Applicants should confirm the current requirements with the Immigration Department.
Is MPF required for imported talent?
Most employees working in Hong Kong are generally covered by the MPF system, subject to the statutory coverage rules and exemptions; the offsetting arrangement was abolished for post-transition periods.
When should I apply for an extension of stay?
You may apply for extension of stay before expiry for major talent schemes; apply early to avoid any lapse.
Can I work in the GBA while holding a HK talent visa?
A Hong Kong talent visa governs stay and work in Hong Kong.
